Terms & Conditions

• “Platform” — The Barbify SaaS application, website, and related services.
• “User” / “Barber” — Any individual or business that registers for and uses Barbify.
• “Client” — An end customer who books appointments through a barber's Barbify booking page.
• “Referral Credit” — A monetary credit (€10) applied to a User's Stripe account balance.
• “Subscription” — A paid plan (monthly or annual) that provides continued access to the Platform after the free trial.

Barbify operates a referral programme that allows registered Users (“Referrers”) to invite other barbers (“Referred Users”) to join the Platform. Both parties may earn a €10 credit under the conditions set out below.

2.1 Referral Codes

• Each registered User receives four (4) unique, single-use referral codes per calendar year.
• Codes follow the format: barber name prefix + 4-digit number (e.g. “john1234”).
• Each code may only be used once. Once used, the code is permanently deactivated.
• Unused codes do not carry over to the following year; new codes are issued each January.
• Codes must be entered by the Referred User inside their Barbify dashboard or profile settings.

2.2 Eligibility & Conditions for Earning Credit

• Referral credit is awarded only when a genuine, independent barber registers using a referral code.
• Credit is applied only after the Referred User completes one of the following conditions:
  • Completes three (3) successful monthly subscription payments; or
  • Three (3) calendar months elapse from the date of their annual subscription purchase.
• Both the Referrer and the Referred User receive €10 credit each when the condition is satisfied.
• A maximum of four (4) successful referrals per User per calendar year are eligible for credit.
• Credit is applied automatically to the User's Stripe customer balance and reduces their next invoice. No manual redemption is required.

2.3 Anti-Abuse & Restrictions

• Users may not refer themselves or create duplicate accounts to generate credits.
• Referral codes may not be sold, auctioned, or transferred for monetary value.
• Barbify reserves the right to void credits, suspend, or permanently ban accounts found to be gaming or abusing the referral system.
• If the Referred User cancels or fails to maintain an active subscription before the condition is met, no credit will be issued.
• Credit has no cash value and may not be exchanged for cash, transferred, or applied to third-party services.

2.4 Credit Expiration

Referral credits expire twelve (12) months after they are applied if unused. Credits are applied against the next invoice automatically and do not accumulate as a cash balance beyond the scope of active subscriptions.

3.1 Plans & Billing

• Barbify offers a 21-day free trial. No payment method is required during the trial period.
• Paid plans are available on a monthly or annual billing cycle and are processed via Stripe.
• All prices are inclusive of VAT where applicable under Irish and EU law.
• Barbify reserves the right to change pricing upon 30 days' written notice to registered Users.

3.2 Cancellation

• Users may cancel their subscription at any time via the Billing section of their dashboard (Customer Portal).
• There is no notice period and no cancellation fee.
• Upon cancellation:
  • Monthly plans remain active until the end of the current billing period.
  • Annual plans remain active until the end of the paid annual term.
• No refunds are issued for any portion of a billing period already paid, whether monthly or annual.

3.3 Failed Payments

If a payment fails, Barbify will attempt to notify the User by email. Access to the Platform may be restricted if payment is not resolved within a reasonable period. Barbify reserves the right to suspend or terminate accounts with outstanding unpaid balances.

Barbify is committed to protecting your personal data in accordance with the General Data Protection Regulation (GDPR) (EU) 2016/679, the Irish Data Protection Acts, and all applicable EU data protection legislation.

4.1 Data We Collect

• Account information: name, email address, phone number, business details, and subdomain.
• Profile information: photos, bio, service descriptions, operating hours, location, and social media links voluntarily provided by the User.
• Payment data: processed securely via Stripe. Barbify does not store card details.
• Appointment and client data: managed entirely by the User within their tenant environment.
• Usage data: anonymised analytics to improve the Platform.

4.2 How We Use Your Data

• To provide and operate the Platform, including booking, scheduling, and communication features.
• To process subscription payments and apply referral credits.
• To send transactional emails (booking confirmations, reminders, account notices).
• To display your public barber profile on the Barbify marketplace (barbify.ie/barbers).
• To comply with legal obligations.

4.3 Your Rights

Under GDPR, you have the right to:

• Access — Request a copy of personal data we hold about you.
• Rectification — Request correction of inaccurate or incomplete data.
• Erasure — Request deletion of your data, subject to legal obligations.
• Portability — Receive your data in a structured, machine-readable format.
• Objection — Object to processing based on legitimate interests.
• Restriction — Request that we limit how we process your data in certain circumstances.

You also have the right to lodge a complaint with the Irish supervisory authority, the Data Protection Commission (DPC): dataprotection.ie, +353 57 868 4800, info@dataprotection.ie.

4.4 Data Storage & Security

• Data is stored on secure servers within the European Economic Area (EEA).
• Access is restricted to authorised personnel only.
• Passwords are stored using PBKDF2 key derivation with SHA-256 and 120,000 iterations.
• All data in transit is encrypted via TLS/HTTPS.
• We retain account data for as long as your account is active. Upon account deletion, data is removed within 30 days, except where legal obligations require otherwise.

4.5 Third-Party Processors

We use the following third-party processors, each subject to appropriate data processing agreements:

• Stripe — Payment processing (stripe.com)
• Resend — Transactional email delivery (resend.com)
• Cloudflare — DNS, CDN, and DDoS protection (cloudflare.com)

By completing your Barbify profile and enabling marketplace listing, you explicitly consent to Barbify displaying the following information publicly on the Platform and in search engine results:

• Your business name, subdomain, and public booking page.
• Your barber profile photo and hero banner image.
• Your business address, city, and county.
• Your services, pricing, and operating hours.
• Client reviews that you have approved for public display.
• Your bio and social media links.

You may update or remove public content at any time via your dashboard. Profile score threshold for marketplace inclusion is ≥ 40/100.

You represent and warrant that you have the right to publish all content (including images) uploaded to the Platform and that such content does not infringe the intellectual property rights of any third party.

6.1 Acceptance

By accessing or using Barbify, you confirm that you are at least 18 years old, legally capable of entering into a binding contract, and that you accept these Terms in full.

6.2 Permitted Use

Barbify is provided solely for legitimate barbershop management and appointment booking purposes. You agree not to:

• Use the Platform for any unlawful or fraudulent purpose.
• Attempt to access, tamper with, or disrupt the Platform's servers or security systems.
• Scrape, crawl, or extract data from the Platform without prior written consent.
• Impersonate another person or misrepresent your identity or affiliation.
• Upload malicious code, viruses, or any content that interferes with Platform operation.

6.3 Intellectual Property

All intellectual property rights in the Platform, including its design, software, and branding, are owned by or licensed to Barbify. Users retain ownership of content they upload but grant Barbify a non-exclusive, royalty-free licence to display, store, and reproduce such content for the purpose of providing the Platform.

6.4 Limitation of Liability

To the fullest extent permitted by law, Barbify shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Platform, including but not limited to loss of revenue, clients, or data.

Barbify's aggregate liability to you in connection with these Terms shall not exceed the total subscription fees paid by you in the three (3) months preceding the claim.

6.5 Service Availability

Barbify aims to maintain high availability but does not guarantee uninterrupted service. We reserve the right to perform maintenance, introduce updates, or modify features with reasonable notice where practicable.

6.6 Account Termination

Barbify reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or where required by law. Users may close their account at any time by contacting info@barbify.ie.

We aim to respond to all enquiries within two (2) business days. For GDPR-related requests, we will respond within 30 calendar days as required under Article 12 of the GDPR.

Barbify reserves the right to update these Terms at any time. Where changes are material, we will notify registered Users by email at least 14 days in advance. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of Ireland. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the Irish courts. If you are a consumer, you may also have rights under the laws of your country of residence.
